Here we have a federal judge claiming that Trump can’t issue an executive order to repeal DACA which was unconstitutionally implemented by an executive order.

A federal judge in California temporarily blocked the Trump administration's decision to end the Deferred Action for Childhood Arrivals program late Tuesday night.

Widely known as DACA, the program protects young immigrants from deportation. In September, Attorney General Jeff Sessions announced that the program would be phased out.

President Obama implemented the program in 2012; it has protected about 800,000 people who were brought to the United States as children by their families, some of whom overstayed their visas. Under the program, young adults, often referred to as "Dreamers," have been permitted to live and work legally in the U.S.

The ruling from U.S. District Judge William Alsup in San Francisco granted a request by California and other states to keep DACA going, at least until lawsuits can play out in court.

Responding to the news on Wednesday morning, President Trump tweeted, "It just shows everyone how broken and unfair our Court System is when the opposing side in a case (such as DACA) always runs to the 9th Circuit and almost always wins before being reversed by higher courts."

These federal judges in California are something else. They don’t interpret law. Instead, they just issue rulings that thwart anything Donald Trump tries to do. How is this even allowed? This is judicial malpractice of the worst kind.

The President is obviously operating within the scope of his office if he wishes to revoke a previously issued executive order. The fact that a court is able to dispute this is utterly insane.

Ultimately, this ruling doesn’t mean a whole lot but it does illustrate how fucked up the current system is.

It looks like the President is angling to strike a deal with Congress to get the border wall, an end to chain migration and an end to the diversity lottery in exchange for some type of DACA fix. We’ll just have to see how this goes. It’s hard to say what the final result is going to be right now.

If Obama could implement DACA with the stroke of a pen then Trump should be able to undo it with the stroke of a pen- amiright?
